These Terms & Conditions (“Terms”) govern your use of PrimalTim.com, the Modern Mismatch Quiz, and the Primal Wellness Coach (together, the “Services”), operated by Tim Ash Enterprises, a California corporation (“we,” “us,” “our”). By using the Services, you agree to these Terms. Please also review our Privacy Policy, which explains how we collect, use, and share your information.
The Services
The Modern Mismatch Quiz assesses alignment across nine practice areas drawn from Primal Wellness. The Primal Wellness Coach is a paid subscription service that provides AI-generated coaching guidance based on your quiz results, along with optional accountability check-ins delivered by email and/or SMS.
Not Medical Advice
The Services are educational and motivational in nature. They are not a substitute for professional medical, psychological, or nutritional advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making changes related to your health, sleep, diet, fasting, exercise, or mental well-being, and before disregarding professional medical advice because of something you read or were told through the Services. The Primal Wellness Coach will not provide guidance on medication interactions, injury diagnosis, disordered eating, or mental health crises — if you raise these topics, you will be directed to seek qualified professional care.
Subscriptions and Billing
Access to the Primal Wellness Coach requires an active paid subscription. Subscriptions renew automatically at the interval selected at signup until cancelled. You may cancel at any time; cancellation stops future renewal but does not refund the current billing period unless required by law.
Accountability Check-Ins (Email and SMS)
Accountability check-ins are entirely optional and are never required to use the Modern Mismatch Quiz, subscribe to the Primal Wellness Coach, or use any other part of the Services. If you affirmatively opt in using the separate SMS consent checkbox provided at signup, we will send periodic check-in messages related to commitments you set with your coach. Message frequency varies based on your activity and the commitments you set. Message and data rates may apply for SMS. You may opt out of SMS at any time by replying STOP, or request help by replying HELP. You may opt out of email check-ins using the unsubscribe link in those messages. Wireless carriers are not liable for delayed or undelivered messages.
Account Access
Access to your coaching account is provided through a secure link tied to your email address, without a traditional username and password. You are responsible for keeping any link or access credential we send you confidential.
Eligibility
You must be 18 years of age or older to use the Services. If you choose to opt in to SMS accountability check-ins (which is entirely optional), you additionally represent that you are at least 18 years old.
Acceptable Use
You agree not to misuse the Services, including attempting to access another person’s coaching account or data, interfering with the Services’ operation, or using the Services for any unlawful purpose.
Disclaimer of Warranties
The Services are provided “as is” without warranties of any kind. We do not guarantee any specific health outcome from using the Services.
Limitation of Liability
To the fullest extent permitted by law, Tim Ash Enterprises is not liable for indirect, incidental, or consequential damages arising from your use of the Services.
Changes to the Services or These Terms
We may modify the Services or these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
